It's illegal, licence or not. Copyright law is pretty international, you know. But:

  • If it's not licensed, no one cares, not even the copyright holders.
  • If it's licensed and not out yet, damn near no one cares.
  • If it's licensed and released, the fansubbers sometimes care. ADV cares, too. Some other companies maybe, but at least no one is going around suing anyone like the *AA.

Don't delude yourself, it was never anything but a kiddy show. It's a morning kids' show, and it's serialized in Shounen Jump, kiddy magazine extraordinaire (just like Dragonball Z and Yugioh).

It was a kid's show but that didn't mean it didn't have any appeal for older audiences. Shonen Jump readership doesn't suddenly stop at 12 year olds.

Indeed. It's usually a given that the Japanese versions of kiddy shows have more content that would help it appeal to older audiences as well... even if it's only something like the soundtrack.

In fact, most anime are kiddy shows. Just when it's brought to America, they try to further define it because of the difference in culture.

No, most of of the otaku shows are aimed at teenagers (and older, especially the otaku-interest shows, but mostly teenagers). That's really stretching the definition of a "kiddy" show a bit too far.

If you want a quick rule of thumb, anything that airs in the morning is a kiddy show, anything that airs at night isn't. There're some shows that defy this classification, of course, but as a very general rule it works well. (Notable exceptions that come to mind are Eureka 7, which aired in the mornings but was aimed both at kids and older fans, and Maria-sama ga Miteru, whose first season aired at night and the second in the morning.)
