let's just assume that one day cops raid your home and take your harddrives to the station for checking..
there they find mp3 files from various artists..
let's say they found 100 mp3 files that you "ILLEGALY downloaded".
now, let's say in court, they say you will be paying back 100$ for those 100 "stolen" mp3's.
i would say: this is total fu*king bullshit.
---------------
out of 100 music files, atleast 35 has been played in radio or on TV musicstations... making them LEGAL to download
beacuse the download could be a LEGAL RIP from the TV or radio station.
( example: it's not illegal to download simpsons season 1 )
( example: it's not illegal to tape/record simpsons season 1 from TV, therefor it's legal to download a TV rip..)
Now lets continue.
out of 100 music files, atleast 10 of the songs you have on your harddrive, you have on a bought cd/vinyl/ or DVD.
NOTE:it's NOT illegal to make a rip of a cd you own unless you should share that file.. ( there is no fucking way they
could check that anyway ) looking and spying on what you do on the internet is illegal for anybody.. even the cops.
It's not over yet..
Today generation Bands put up their entire CD's on various music communities such as MYspace.. Nine inch nails 'for
example' put up the entire new CD on Myspace before it was released into the stores.. another example is weezers new
CD.
therefor.. it's SO FUCKING LEGAL to download the entire new Nine Inch Nails album beacuse you can rip it directly from
myspace.. legaly.. as legaly as you would rip any song from the radio or TV.. it could be a Myspace RIP you downloaded
..
atleast 20 out of 100 songs on your harddrive have been put up on some music community somewhere legaly..
--------------------
ALRIGHT.. LETS DO THE MATHS
100-35-10-20 = 35
and even here.. 2 out of 35 songs may be free legal downloadale demos from the artists homepage..
how are the cops gonna prove that they are not? maybee they were but are not anymore.
-----
so by all means. please go and download the new Nine Inch Nails album 'With Teeth'..
Go download the latest single.. beacuse it has aired on radio and TV..
and dont you damn worry.. its fucking LEGAL..
2get
I think a lot of this lawsuit strategy is based on picking on people who are too poor, clueless or weak-willed to fight back in court. You notice they never target geeks, just Amanda Doe the suburban mother who warezed a Madonna ditty or two.
Didn't the RIAA say they are more focussed towards targeting people who upload copyrighted material as opposed to the downloaders?
uploading legal items isn't illegal.
sharing legal items isn't illegal.
i can be uploading a tv recorded - Simpsons season 1, and upload it on any p2p.. it still would be legal beacuse im not sharing anything illegal.
but who the fuck wants simpsons.. (you get the idea tho)

Actually, I think the courts decided that the decision in the case about vcrs doesn't apply to filesharing
>>6
vcrs?? try dvd.. i have internet TV... i rip directly to DVD..
>>7
Um. I was refering to a court decision that was originally being used to defend online file sharing that was originally made pertaining to vcrs.
HURHURHUR
I live in Canada.
WE HAVE NO RIAA.
:D
LOL they can't make me pay anything for my downloaded jpop collection because you can't even get those CDs in Finland! :DDDDDD

You do realize that downloading stuff from the internet isn't legal just because the stuff has aired on TV? Sharing recordings has never been legal.
Also, it's true the cops and the RIAA most probably couldn't prove that you didn't legally rip all the stuff on your HD from internet radios and CDs you own (If they had no logs of you doing so, which they would most probably have, beause if they had no such logs, they wouldn't try suing you. They're not stuipd, you know.), but still, would you fight everything out before court against a Mafia-style Multimillion dollar organization, even when you know that you did download stuff illegaly?
My simple suggestion: Go by the rule "If I wouldn't pay for it, then it sucks and isn't even worth the time that would be spent DL'ing it.". Works very well, and you'll probably stop listening to crap.
uh. just because something has been shown on tv by no means gives you the right to download it on the internet. that's the most retarded thing i have ever heard.
think about it. sharing tv shows on the internet is completely illegal. just because something is shown on the TV does not put it into open domain or whatever the hell it's called. in fact, that is NEVER the case
Hey kids, how about we read up on the WTO TRIPS Agreement and the Berne Convention, as well as whatever your country's copyright laws are. That way you can all shutup about whatever your interpretation of the law is. The only people that can decide how a law is interpretted is the judge when they are sentencing to you to federal-pound-me-in-the-ass prison.
it's not legal to record most things without express written consent.
If you record something off the TV; it's considered a legal use of a VCR (or other recording device), however it is not legal to share it.
if you downloaded it via a torrent or any other P2P application, you're also distributing it, which is illegal.

Under the USA's "Fair Use" rights, you are allowed to record broadcasted TV, or about performing any sort of transcoding of intellectual property, provided it remains within your personal domain. However, under Australian "Fair dealing", all forms of transcoding is illegal.
Please remember that whilst you can say what is, and what isn't illegal, there are so many people from different countries here that the copyright laws in your region do not apply to some of the other posters.
