'Diaper man' arrested for lewdness at recreation center (7)

EAST MILLCREEK, Utah (ABC 4 News) - A man known to police as “Boy Diaper” is back in jail.

31-year old Barton Bagnes was arrested yesterday accused of showing a diaper he was wearing to children.

But authorities said it is not the first time Bagnes has been involved with this kind of crime.

In 2000, he was convicted for a similar crime, served jail time and was placed on the Utah Sex Offender Registry. His alias on the registry is listed as “Boy Diaper.”

And in February, he was charged with 11-counts of lewdness for exposing himself to young boys in Holladay.

Melissa Rideout and Etienne Brasher claimed it was their sons who were victimized by Bagnes in February.

"He always had a big bag on him with diapers in it and he would ask the kids if they wanted to see it and he would pull his shirt up and pull his pants down to show that he was wearing diapers,” said Bagnes.

Yesterday, sheriff investigators said Bagnes came to the Evergreen Rec Center in East Millcreek where he allegedly exposed his diaper to children.

An employee spotted him and called 9-1-1.

"We're frustrated because we've arrested him numerous times and it seem like he's back out on the street," said Lt. Paul Jaroscak of the Salt Lake County Sheriff’s office.

The 31-year old Bagnes lives with his parents in Holladay.

His mother claimed her son suffers from dyslexia and was a victim of bullying during school. She says he never recovered.

"Maybe his happiest times were when he was a child and so he has this fixation with children,” said Mari Bagnes.

In regards to the diaper he is seen wearing, Mari Bagnes said “that's another problem, that's a physical problem."

But those living on Kentucky Avenue have no sympathy with his past. They're upset Bagnes still gets to walk the streets despite his record.

"It’s frustrating to see the system doesn't work,” said Etienne Brasher. “It’s only a matter of time before someone else, he just grosses me out."

A spokesman for the Salt Lake County District Attorney’s office said Lewdness involving a child is a Class A misdemeanor and the maximum punishment is up to a year in jail.

“Our hands are tied, that’s the law,” said Alicia Cook with the prosecutors office. “No matter how many counts, it can’t be enhanced to a felony.”
